These Terms of Service ("Terms") govern your access to and use of the DropThen macOS application and the website at dropthen.com (together, the "Service"), operated by DropThen, Inc. ("DropThen," "we," "our," or "us"). By installing the app, creating an account, or otherwise using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.
You must be at least 18 years old to use the Service. By using DropThen, you represent that you meet this age requirement. If you are using DropThen to manage creator accounts, you represent that all creators whose accounts you manage are also 18 or older and have consented to that management.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@dropthen.com if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.
You may not create an account using a false identity, impersonate another person, or share your account credentials with third parties outside your organization.
Free plan. The free Drop tier is available at no cost and includes 1 connected platform and 30 uploads per calendar month. No credit card is required.
DropThen ($5/month). Paid monthly or annually. All platform connections, unlimited uploads, AI caption generation, post analytics, and priority queue. You may cancel at any time; cancellation takes effect at the end of the current billing period.
Hub License ($799 one-time). A perpetual license for agency and team use. Covers all features in the DropThen plan plus multi-creator management tools. Includes 12 months of updates and priority support. Subsequent yearly update packages are optional.
All prices are in USD and exclude applicable taxes. We may change subscription pricing with 30 days notice. Price changes do not affect your current billing period. Continued use after the effective date constitutes acceptance of the new pricing.
Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fees. Failed payments may result in suspension of paid features until resolved.
Monthly subscriptions: we offer a full refund within 7 days of the initial charge if you have not made meaningful use of paid features. After 7 days, monthly charges are non-refundable.
Annual subscriptions: we offer a prorated refund for unused complete months if you cancel within the first 30 days. After 30 days, annual fees are non-refundable.
Hub Licenses: refunds are available within 14 days of purchase if you have not activated the license on more than one machine. After 14 days, Hub License purchases are non-refundable.

Violation of these rules may result in immediate termination of your account without refund.
You retain full ownership of all content you upload through DropThen. By using the Service, you grant DropThen a limited, non-exclusive license to process and transmit your content solely for the purpose of delivering the Service (i.e., posting to the platforms you specify).
You represent and warrant that you own or have the necessary rights to all content you post through DropThen, and that posting that content does not violate any third party's intellectual property rights, privacy rights, or any applicable law.
We do not claim any ownership over your content and will not use it for any purpose beyond operating the Service.
The DropThen name, logo, app design, website, and all associated software are the intellectual property of DropThen, Inc. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.
The Service is licensed to you under these Terms, not sold. Your license is personal, non-transferable, and limited to your authorized use of the Service.
DropThen integrates with third-party platforms (OnlyFans, Instagram, TikTok, Reddit, Fansly, and others). Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for changes to third-party APIs, platform policy changes, content removals, or account actions taken by those platforms.
Platform availability may change. We will make reasonable efforts to maintain integrations but do not guarantee continuous availability of any specific platform connection.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DROPTHEN, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to indemnify, defend, and hold harmless DropThen, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any third party's rights.
You may stop using the Service at any time. You may cancel your subscription by managing your account settings or by contacting us.
We may suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the Service. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you may cancel your account before they take effect.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
